Terms of Service

1. Acceptance of Terms

By creating an account or using LowKeyVPN ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a binding agreement between you and Floppy LLC, a California limited liability company.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's permission. By using the Service, you represent that you have the legal capacity to enter into this agreement.

3. The Service

LowKeyVPN provides a VPN service that routes your internet traffic through US-based servers, providing a US IP address. The Service is intended for lawful purposes including content creation, social media management, and accessing geo-restricted content you have a right to access.

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice. We will provide a prorated refund for prepaid periods if we discontinue the Service.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe the intellectual property rights of others
  • Distribute malware, ransomware, or other malicious software
  • Conduct port scanning, network intrusion, or unauthorized penetration testing
  • Send spam, phishing emails, or unsolicited bulk communications
  • Access child sexual abuse material or any illegal content
  • Engage in cryptocurrency mining or botnet activity
  • Resell or sublicense the Service without written permission
  • Circumvent platform terms of service in ways that cause harm to others

Violation of these terms may result in immediate account termination without refund and, where required by law, reporting to appropriate authorities.

5. Subscriptions and Payment

LowKeyVPN offers monthly and annual subscription plans. Prices are displayed at checkout and on our pricing page. All prices are in USD.

Billing: Subscriptions are billed in advance. Monthly subscriptions renew monthly. Annual subscriptions renew annually. You authorize us to charge your payment method on each renewal date.

Cancellation: You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods on monthly plans.

Annual plan refunds: If you cancel an annual plan within 14 days of purchase and have not exceeded 1GB of data usage, we will provide a full refund. After 14 days, no refund is provided.

Failed payments: If payment fails, we will attempt to collect payment for up to 7 days before suspending your account. Your VPN access will be restored upon successful payment.

6. Data Usage Limits

All plans include unlimited bandwidth for typical creator use (social media posting, content research, streaming for review). We reserve the right to throttle or suspend accounts that abuse bandwidth in ways inconsistent with normal creator use (e.g., continuous high-volume torrenting, using the VPN as a proxy for third-party commercial services).

7. Account Security

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at legal@lowkeyvpn.com if you suspect unauthorized access to your account.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOPPY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Alameda County, California, and you consent to personal jurisdiction in those courts.

Informal resolution: Before filing a formal claim, you agree to contact us at legal@lowkeyvpn.com and attempt to resolve the dispute informally for at least 30 days.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
